Capitalized terms used herein, that are not herein defined, retain the definition(s) set forth in Fireberry's Terms of Service, available at www.fireberry.com/legal/terms-of-service.

In this Privacy Policy, the term "Personal Data" means information that identifies, relates to, describes, can reasonably be connected with, or could potentially be linked, either directly or indirectly, to an individual. It excludes aggregated or anonymized information maintained in a format that cannot reasonably be associated with or linked to an individual.

Fireberry invests significant resources to ensure that your Personal Data is protected and secure. We will never collect and/or process your Personal Data without a clear and reasonable purpose directly correlated with improving and/or proving you the Services as your service provider. Your data security is our top priority. Within the scope of this Privacy Policy, unless expressly stated otherwise, Fireberry is the "data controller" of your Personal Data. However, we are not a "data controller" of information, Personal Data, or any other content that you upload, submit, or transmit through our Services (i.e., Customer Data). 1. How we Collect and Process Your Personal Data and Which Data we Collect

We may collect and/or process your Personal Data when you:
A. visit our offices;
B. visit our branded social media pages;
C. subscribe to, use, our Services and/or Sites, including our mobile application(s);
D. contact us or when we communicate with you via telephone, fax, regular mail, email, text messages (SMS/MMS), WhatsApp, or other communication platform(s);
E. when you share your Personal Data with a third party who works with us. In this event, we may obtain and process information about you from affiliated third parties.

Please note that our Site, products, Services and/or mobile application may contain links to other websites, applications, platforms, and services maintained by third parties. 1.1. Information that you Provide to Fireberry

1.1.1. Account Registration

When you sign up for an account to access one or more of our Services, we ask for information such as your name, email address, contact number, personal identification number and/or company number, company name, country of origin, and any other information necessary to complete your account registration process.
When you register an account, you will also be required to choose a personal username and a password to access your account. At that time, you may also provide us with additional, voluntary details, such as your time zone, preferred language, and other useful information that may help Fireberry better cater to your needs or provide you with a better account interface.
After creating an account, you can choose a security question for two-step verification. This will allow you to retrieve or change your password.

1.1.2. Webinars and Newsletter Submissions

We may record information that you submit when you register for any of our webinars or instructional seminars.
We may also record information that you submit when you subscribe to our newsletter, mailing list and/or when submitting a digital form to download or use any of our products and Service(s).In addition, we may record information that you submit while contacting our customer support, which includes, among other things, our remote support services.

1.1.3. Payment Processing

When you purchase something from Fireberry, we may ask you to provide your contact information, first and last name, credit card number on file, the verification number for your credit card on file (on the back of your credit card), credit card expiration date, personal identification number, or any other necessary detail to process your payment. We will not store your credit card information without your express permission. For purposes of any future payments, and only with your approval, will we store your credit card information or other payment details, in encrypted and secure servers owned and operated by our payment providers.

1.1.4. Reviews and Testimonials

We may store, analyze, and use any reviews, feedback and/or testimonials you submit in any public forum. If you wish to retract any such public statement about Fireberry, please contact us at: legal@fireberry.com.

1.1.5. Interactions with Fireberry

To improve our service(s), we may record and save our communications with you.

1.2. Information Automatically Collected

1.2.1. Information from Devices, Browsers, and Servers

When you visit our Sites, we may collect information retrieved through web browser and web applications such as the internet protocol (IP) address, browser language preference, time zone, referring URL, date and time of access, operation system as well as mobile device manufacturer and mobile network information. We include these in our log files to understand more about visitors to our Sites.

1.2.2. Cookies and Tracking Technologies

We may use temporary and permanent cookies to identify and enhance Fireberry user experience. We also may use cookies, beacons, tags, scripts, or other technologies in order to identify visitors, track website navigation, gather demographic information, and/or enhance or improve general or targeted marketing. We only use first-party cookies and we do not actively use third-party cookies or other third-party tracking technologies on our Sites. We also use first-party local storage objects (LSO), such as HTML5, to store your content and settings preferences.

1.2.3. Information from Application Logs and Mobile Analytics

We collect information about your use of our products, Sites and/or Services from application logs and in-house usage analytics tools and we use this information to improve our products and Services. The information we collect includes user clicks, scrolls, accessed features, time of access, length of access and frequency of access, generated errors, performance data, utilized storage, use of settings and/or configurations, and devices used for access.

1.2.4. Usage of the Services

We collect information from monitoring and recording specific details regarding your interactions with our Services. Such information encompasses the functionalities you utilize, as well as the tasks, projects, teams, and other links you engage with. Additionally, we track the type, size, and filenames of attachments you upload to the Services, commonly used search terms, and your interactions with other Users. Furthermore, we gather information about the teams and individuals you collaborate with, including details about your most frequent communications and collaborations.

1.3. Information that we Collect from Third Parties

1.3.1. Registration using Federated Authentication Service Providers

You can gain access to Fireberry Sites by clicking on a dedicated link published or provided in/on one or more of the following social media platforms: Twitter, Facebook, LinkedIn, Instagram, Google+, and more. Such social media platforms may verify your identity and allow you to share your personal data with us, such as your email address, your first and last name, or additional details that allow us to contact or connect with you.

1.3.2. Information from Social Media Sites and Other Publicly Available Sources

When you interact or engage with Fireberry on social media platforms such as Twitter, Google+, Instagram, Facebook, or other platforms, we may collect your publicly available information to allow us to connect with you, improve our products and Services, or better understand customer's use habits and issues. Once collected, this information may remain in Fireberry's data collection log, even if you delete your publicly available information from the social media platform(s).

1.3.3. Referrals

If someone has referred any of our products and/or Services to you through any of our referral programs, that person may have provided us with your name, phone number, email address, or other Personal Data. In such cases, you may contact us at support@fireberry.com. to request that we remove your Personal Data from our system. If you provide Fireberry with Personal Data about another individual, or if another individual or entity provides us with your Personal Data, we will only use that Personal Data toward the specific reason for which it was provided to us and only if it was provided to us for a reasonable legitimate reason.

1.3.4. Information from our Reselling Partners and Service Providers

If you contact any of our reselling partners, or otherwise express interest in any of our products or Services, the reselling partner may remit to us your name, email address, company name, or other contact details that you provide to the reselling partner. If you register for or attend an event that is sponsored by Fireberry, the event organizer may share your information with us. We may also receive your information from sites offering reviews of our products and services, if you leave a review and/or comment on any review of our products or services, as well as from other third-party service providers with whom we engage in marketing our products and services.

2. Data Uses & Legal Bases

Fireberry may collect, process, and use your Personal Data, as necessary to comply with our legal and contractual obligations; and to support our legitimate interests in maintaining and improving our Services, for, but not limited to, one or more of the following reasons:

2.1. To track how visitors to our Sites navigations on one or more of our platforms so that we can understand what visitors are looking for, analyze trends, and/or better administer our Sites;

2.2. To monitor and improve our marketing efforts, offer relevant and helpful suggestions to User(s);

2.3. To update, analyze, and expand our records; identify new customers; and provide products and services that may be of interest to you;

2.4. To ask you to participate in surveys, or to solicit feedback about our products and Services(s);

2.8. To detect and prevent fraudulent transactions or other unauthorized and/or unlawful activities, to report spam and to protect the rights and interests of the company, the company's users, third parties, and the general public;

2.9. To communicate with you about your purchase and/or use of our products and/or Services, as well as changes to our Privacy Policy, changes to our Terms of Service, and to communicate to you other important notices regarding our products and Services;

2.10. To keep you informed about our new products and Services, upcoming events, offers, promotions, or other information that we think will be of interest to you;

2.11. To process your Personal Data as we assess our Services capacity requirements, to the extent we are obligated to do so;

2.12. To comply with any legal obligations that may arise to the extent we are required to share your Personal Data with governmental or regulatory authorities, including competent courts.

2.13. To improve quality assurance, we may record your phone calls with Fireberry. If required by law, we will ask for your consent to make such recordings.

2.14. For any other lawful purpose, or any purpose to which you provide consent in connection with the provisioning of our Services;
In relation to personal data acquired through Google OAuth API Scopes, employed in our integration with specific Google Services
("Integrated Google Services"), our utilization of such personal data and data that is aggregated, anonymized, or derived from it ("Acquired Personal Data") is restricted to the following purposes, in compliance with the “Limited Use” requirements outlined in the Google API Services User Data Policy (version dated August 22, 2022):

2.14.1. For our internal operations, provided that the Acquired Personal Data (including derived forms) has been aggregated and anonymized;
2.14.2. To adhere to relevant laws and regulations;
2.14.3. To support, facilitate operate provide and improve user-facing features that are prominent in the Integrated Google Services;
2.14.4. For troubleshooting or security purposes, such as investigating bugs or potential abuse, and subject to Users' prior consent, accessing Acquired Personal Data is permissible to address support-related issues
2.14.5. To transfer the Acquired Personal Data to third parties: (a) in alignment with this Privacy Policy, solely for the purpose of delivering or enhancing the Integrated Google Services; (b) to comply with applicable laws and regulations; and (c) in the event of any change in control, such as a merger, acquisition, or the acquisition of a substantial portion of Fireberry's assets (Performance of Contract; Legitimate Interests; Legal Obligation); or otherwise, strictly pursuant to your affirmative agreement.

3. Legal Rights and Restrictions

Collecting and processing your Personal Data may be subject to certain exemptions based on the laws of your country.
With respect to your Personal Data, based on relevant laws within the country where you are using our Services and Sites, you may have the right to:A. Gain access to your Personal Data ;

3.1.1. The right of rectification and erasure

You have the right to request that we rectify any inaccurate Personal Data. We may verify the accuracy of your Personal Data that you ask to be corrected, before rectifying it per your request. You can also request that we erase your Personal Data where it (A) it is no longer needed for the purposes for which it was collected; (B) you have withdrawn your consent where the legal basis for information collection and use was based on your consent; (C) Following a legitimate reason to object, where you have the right to do so; (D) your Personal Data has been processed unlawfully. We are not obligated to comply with any request to erase your Personal Data if the collection and processing of your Personal Data are necessary to comply with a legal obligation or to exercise or defend any legal claim.

3.1.2. The right to gain access to your Personal Data

You have the right to request access to or obtain a copy of your Personal Data. You have the right to be informed of several details concerning the processing of your Personal Data, and this Privacy Policy attempts to provide you with this information. Please keep in mind that the exercise of your rights will be limited to the extent we believe is required to avoid harming the rights or freedoms of others, as well as for other legitimate reasons necessary under applicable laws.

3.1.3. The right to restrict the processing of your Personal Data

Where the legal basis for information collection and use of your Personal Data is our legitimate interests, you have the right to object if you believe your fundamental rights and freedoms outweigh our legitimate interests. If you raise an objection, we will have the right to demonstrate that our legitimate interests override and/or do not violate the rights and freedoms you allege are being infringed upon.

3.1.4. The right to data portability

You may request that we provide you with a copy of the Personal Data that you provided to us, which will then be provided to you in a structured, common-use, machine-readable format, or you may request, in writing, to have your Personal Data transferred directly to another "data controller", but only where: (A) the legal basis for information collection and use is based on your consent, or on our performance of a contract with you; (B) the processing is carried out by automated means.

3.1.5. The right to file a complaint with the supervisory authority

You have the right to file a complaint with your local supervisory authority if you have concerns about how we are processing your Personal Data. We ask that you please attempt to resolve any issues with us first, although you have the right to contact your supervisory authority without doing so.

3.2. California Privacy Rights

Fireberry complies with the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act ("CPRA"). Subsequent sub-sections provide detailed information about our privacy practices and outline your rights with respect to your personal data under the CCPA.

3.2.1. We do not sell your personal information

Fireberry will not sell your Personal Data for the intents and purposes of the CCPA. Consistent with CCPA regulations, Fireberry has implemented robust measures to ensure that your personal data is not sold or disclosed to third parties for monetary compensation.

3.2.2. Information we collect automatically when you use the Services

Section 1 describes the details of the Personal Data we have collected over the last 12 months and the categories of sources of such Personal Data.Such information is collected for business purposes as described in this Privacy Policy.

3.2.3. We collect information for business purposes

Fireberry shall utilize collected Personal Data for legitimate business purposes, as specified in Section 2.

3.2.4. Third Parties with whom we disclose or share your personal information

We only disclose and permit the collection of Personal Data by third parties from our Services as detailed in Section 5.

3.2.5. Data retention and security

Sections 7 and 8 detail our data retention policies and security measures.

4. You Control the Information you Receive from Fireberry

You may opt out of our newsletter or any other "non-essential" communications that we send to our customers or potential customers in the usual course of business, by clicking the following link and completing the necessary form. Be aware that we will continue sending you important information via email or through our Services, even if you opt out of such "non-essential" communications.

5. With whom we may share your Personal Data

Fireberry will never sell your Personal Data and we will only share your Personal Data based on one or more of the legitimate reasons, described within this Privacy Policy, and we will only share your Personal Data with parties that adopt appropriate confidential secured measures.

5.1. Third-party Service Providers with whom we Work

We may need to share your personal data and/or any data that we collected about you with third-party data providers with whom we work, including, but not limited to, partners in marketing and advertising, payment processors, web analytics providers, event organizers, technology service providers, and system administration and hosting service providers. These service providers are authorized to use your Personal Data only insofar as is necessary to fulfill the services provided to Fireberry.

5.2. Reselling Partners

We may share your Personal Data and/or data we collected about you with one of our authorized reselling partners, solely for the purpose of contacting you about our products and/or Services. You can choose to prevent your Personal Data from being shared with any reselling partner by contacting us at  legal@fireberry.com.

5.3. Fireberry Employees and Independent Contractors

Our employees have signed a confidential agreement under which they are forbidden to disclose your Personal Data to any individual or party or discuss, publish, or use your Personal Data for any purpose outside of work.
Our employees will only use your information insofar as is necessary to fulfill the duties and obligations of their employment with Fireberry. Fireberry may work periodically with independent contractors, who may gain limited access to your Personal Data, as described in this Privacy Policy. In such case, such an independent contractor shall be subject to the same binding confidentiality agreement applicable to all Fireberry employees.

5.4. Professional Advisors

In some cases, we may share your Personal Data with professional advisors, such as, but not limited to: lawyers, bankers, accountants, insurers, and/or consultants, and only to such extent as we are legally obligated, or due to one or more legitimate reason(s).

5.5. Third Parties Involved in Major Corporate Transactions

In the event of a major fundamental corporate change, such as, but not limited to: reorganization, merger, dissolution; or in the event we fully or partially sell the business, or list Fireberry on the stock exchange via IPO, DPO, SPAC merger, or another public exchange, your Personal Data may be shared only to the extent necessary and relevant to the transaction taking place, and governed by applicable laws or regulations.

5.6. AppExchange Partners

With regard to our AppExchange services, should you choose to use third-party tools, we may share your Personal Data with one or more of our third-party partners with whose tools you choose to use.

5.7. Third party Promoters

We may share your Personal Data with third-party social media networks, advertising networks and/or websites in such a way that allows us to publish our products and Services to the public.

6. Minors

Our products and Services are not meant for children, and therefore, we shall not knowingly collect and process Personal Data from children who are legal minors in the jurisdiction where they reside and/or are using our products and Services unless we have first obtained permission from their parents or legal guardians.If you are the parent or the legal guardian of a child who is using our products and/or Services without your parental consent, please contact us at legal@fireberry.com.

7. Data Retention Period

We may retain your Personal Data for the necessary period consistent with the purpose for which we first collected and processed your Personal Data, and/or when we have a legal and/or contractual obligation to do so. If we are not required to retain your Personal Data based on a legal and/or contractual obligation, Fireberry will decide the appropriate period to retain your Personal Data based primarily upon the following parameters: (A) Data sensitivity; (B) Data importance; (C) potential risk of harm if the Data is disclosed to an unauthorized third party; (D) size of the Data.
At the end of the retention period, Fireberry will delete your Personal Data. In case we are unable to delete all or part of your Personal Data, due to technical reasons or any other reasonable reason, we shall employ all necessary security measures to prevent the use or disclosure of your Personal Data.

8. How we Protect your Personal Data

To mitigate the risk of unauthorized use and disclosure of your Personal Data, we implement appropriate safeguards and uphold robust security measures.While we have implemented adequate measures to protect your Personal Data, no method or system is 100% secure. 9. Data Location

Fireberry and our authorized service providers mainly collect, process, and store your Personal Data within Israel and the United States, but we may collect and process your Personal Data in other locations, as needed to ensure proper service performance.
Fireberry complies with the European Commission GDPR regulations regarding EU citizens, as detailed herein, and we are committed to implementing proper security measures to ensure that all Personal Data that is collected and processed outside of the above-named jurisdictions that do not offer the same level of data protection, is securely protected.

10. Changes and Updates to our Privacy Policy

We reserve the right to revise this Privacy Policy periodically by posting an updated version on our Sites. Such revisions become effective on the date they are posted. In the event of significant modifications to this Privacy Policy, we will provide appropriate notice, either through a prominent notification within the Services or by sending an email notification.

11. Acceptance of our Privacy Policy Statement and our Terms of Service

Your continued use of the Services following the implementation of any changes to this Privacy Policy constitutes your acceptance of the revised Privacy Policy.

12. Translated Versions

For convenience, we may translate our Privacy Policy into other languages. Should there be a conflict between one or more of the non-English versions of our Privacy Policy, and the English version, the English version of our Privacy Policy shall prevail.
